South Dakota urology clinic wants judge to dismiss Iowa patients …

(AP) — Lawyers for a South Dakota clinic have asked a judge to dismiss a lawsuit filed by five Iowans who might have been exposed to blood-borne infections such as hepatitis and HIV. Former patients Theresa Kinney Katherine Moir Gloria Todd James Peters and William Collins filed the case against Siouxland Urology Center and its six owners: Drs. John Wolpert David Howard Patrick Walsh Kenneth McCalla Timothy Kneib and Craig Block. The center sent letters to patients telling them that single-use products such as saline solution bags and tubing were used on more than one person before being discarded. A clinic spokeswoman says about 3800 patients have been tested but results on whether there were any positive tests won’t be released until everyone is notified.

In the June issue of Urologia Internationalis Hemal a professor of urology reports on three patients whose fistulas were repaired with robot-assisted surgery a minimally invasive option that requires only five small incisions. In one case a hysterectomy was also performed in addition to repairing the fistula. Hemal has previously reported his experience using the technology to repair other types of fistulas. "Robotic repair was successful in all cases with mean operative time of 175. 5 minutes and all patients being discharged on the third day after surgery" said Hemal in an interview.

We retrospectively reviewed the records of all patients who were seen at our institution in consultation for urologic malignancy from August 2002 to April 2008. All available pathologic slides were reviewed by the urologist and pathologist at the time of consultation and compared with the original diagnosis. Discrepant diagnoses were reviewed by at least 2 pathologists.

Frank Gunsberg executive managing director at FirstService Williams advised ownership in the deal while John Feeney of Studley represented the tenant. Gunsberg tells GlobeSt. com that the Urology Group of New Jersey is made up of several medical practices that have come together to form a prostate cancer treatment center. The building was attractive to the tenant because of its high ceilings and the large amount of floor space that is on grade which can therefore accommodate the practice’s heavy equipment such as a linear accelerator that is used for radiation treatments he says. Gunsberg declined to give specifics on the rental rate but says the rent is over $30 per square foot which is a market rate for new medical space. The deal also includes an option to buy another plus for most doctors. “This kind of transaction involves a great deal of capital” Gunsberg says.
